Ayon kay Federation of International Cable TV and Telecommunications Association of the Philippines Chairman Estrellita Tamano, ang mahiwang blackbox ng ABS-CBN ay hindi dapat ibinibenta, dahil ang frequency na ginagamit doon sa mahiwagang black box ay test frequency. ABS-CBN utilized UHF channel 51 Manila (695.143 MHz), later UHF Channel 43 (647.143 MHz), for TEST broadcasts in the DVB-T format. ABS-CBN begin digital test broadcasts In January of 2009.
ABS-CBN TVplus has sold over 9 million units of its set-top boxes. The Black Box average cost is 1,500Php. so 1,500 x 9Million. For the black box alone, ABS-CBN earned 13.5 Billion Pesos. Also, they offered a pay-per-view with ABS-CBN TVplus. I believe you also have to pay to subscribe to some channels.
The Black Box Operation also violates NTC law, that one Frequency is equal to 1 channel. The Black Box is offering 13 channels.
So sa madaling Salita, ang violations ng ABS-CBN ay:
- Gumamit ng isang Frequency for 13 Channels na dapat isa lang
- 1 franchise is equal 1 channel but ABS-CBN have only one Franchise and 13 Channels.
- Pinagkakitaan ang Test Frequency na dapat libre
- Pinagkakitaan ang TV Plus box

My take on the closure of ABS-CBN.
Ako man ay feeling sad sa pagpapasara ng ABS-CBN kasi lumaki ako na mga palabas nila ang pinapanood ko. It's so painful to see them ending their service to us, Filipinos, however allow me to enlighten your minds why this thing happened. (I will base my points on the interview aired on 24 Oras)
If you were watching 24 Oras, the News Veteran Jessica Soho (which I would like to commend for treating the news and interview fairly) was interviewing FICTAP Chairperson Estrellita Tamano, she enumerated reasons why the Kapamilya network had to be closed. I will try to simplify it for everyone to understand.
(1) the network altered their original franchise in 1995. Sabi ni Tamano, ang nakalagay sa franchise ay "channel" and in franchising, according to her, follows one channel, one franchise rule. Ang ginawa ng Kapamilya network was to change it to "channels".
(2) At dahil channels na siya, may mga idinagdag na channels and programs ang Kapamilya, through the ABS-CBN blackbox, na hindi naka stipulate sa contract which was an obvious na pagbalga sa kontrata.
(3) At dahil may blackbox na nga kng saan ilegal na nagdagdag ng channels ang Kapamilya, naningil pa ng bayad ang istasyon sa mga tao if they avail the service of that blackbox where in fact ang nsa kontrata ay ang airing ng channel ng ABS should be free.
(4) Ano ba ang naging epekto ng blackbox? Humina ang subscriptions sa cable networks causing them to ask for an investigation of said service ng Kapamilya.
(5) Binigyan ng almost 5 years na mag explain ang Kapamilya regarding sa hindi nila pagsunod sa kontrata, however, NTC has not receieved any interest to answer.
I don't think what happened to ABS-CBN is an oppression of press freedom. Kasi ang oppression ng press freedom ay kung LAHAT ng stations, networks, and all forms of media sa Pilipinas ay ang ipinasara. GMA and TV5, for instance, are still airing. So, saan ang oppression diyan?
As how I see it, pinasara ang Kapamilya Network because may pagkukulang sila. And it would be most unfair to allow them air na may violation sila tapos yung ibang networks matinong sumusunod sa batas.
Let's simplify it some more:
Para lang yan tatlong malaking supermarket. Yung isa may permit (Kapuso), yung isa naman hindi masyadong malakas ang benta pero may permit to operate (Kapatid), pero yung isa sobrang lakas ng bentahan pero wala palang permit to sell (Kapamilya). Now, sino ang sa tingin ninyo ang dapat ipasara?
